Expungement of Law Enforcement Records
JUVENILE RECORDS:
The Hinsdale Police Department will automatically expunge juvenile law enforcement records as set in 705 ILCS 405/5-915.
Law Enforcement records include records of arrest, station adjustments, fingerprints, probation adjustments, the issuance of a notice to appear and any other records or documents maintained by the Hinsdale Police Department relating to a minor suspected of, or arrested for, committing an offense. These records do not include local ordinance arrests or citations sent to court or records identifying a juvenile as a victim, witness or missing juvenile.
On or before January 1 of each year, qualifying juvenile law enforcement records relating to events occurring before an individual’s 18th birthday if:
1) One year or more has elapsed since the date of the arrest or law enforcement interaction documented in the records;
2) No petition for delinquency or criminal charges were filed with the clerk of the circuit court relating to the arrest or law enforcement interaction documented in the records; and
3) 6 months have elapsed since the date of the arrest without an additional subsequent arrest or filing of a petition for delinquency or criminal charges, whether related or not to the arrest or law enforcement interaction documented in the records.
Nothing prohibits an individual with a law enforcement record from filing for an expungement prior to the completion of the automatic expungement.
For automatically expunged records occurring after January 1, 2016, a letter will be mailed to the subject and address listed in the law enforcement record. If an arrest required a court appearance, the arrestee must petition the court for expungement. Use the link below for assistance with that process. Records indicating a disposition of Peer Jury, Station Adjustment or release without charges will be automatically expunged.
